CONDO and Townhouse Document Evaluations
A critical factor Investors need to know is whether there are Rental Restrictions in effect when they are purchasing an investment property. Some projects have a one or two year waiting list for units to be allowed to be rented out. This problem could definitely turn what looks like a “good investment” into a nightmare if the investor cannot put a new tenant into the property. While there is no guarantee that homeowners will later vote to recommend Rental Restrictions, it is valuable to know upfront. If the Owner-occupancy is under 50%, it will probably be hard for the owner occupants to organize a majority of the owners to vote for Restrictions. So, typically, that kind of change will only be voted through when they hold a solid majority. Investors get wind of that change coming and usually have time to mount opposition to such plans.
Below, please find the list of the present HOA’s which have had recent listings on the market in my service area. Supplied is the summary information on these topics as well as the contact numbers for the management teams to assist my clients in being able to assess these factors as best as possible if they are contemplating buying into a project. This project is a work in progress. I have not added some cities projects yet because right now am trying to focus on the sweet spot of my service area. Where I saw a discrepancy between multiple agents, I tried to adjust for inaccuracy. But, this data is factual as of the time of the listing and that unit the data was reported about, only. If maintaining this list becomes overly time consuming, I intend to pull the list off of the net, altogether. But for the time being, it may serve my clients well in making a quick assessment of the project as a target investment. Any prospective buyer should rely on a more detailed analysis by reviewing the actual Disclosure package that they receive once in contract and review the Reserve Study and accompanying financials carefully to feel comfortable with the actual financial stability of the project before signing off on contingencies. As someone experienced in this process, I am always glad to assist my clients in answering questions they have about the documents and doing further exploration with the management company when we are in contract.
One of the many things I bring to the table as an agent is the experience in having been in charge of Project Approval for several lenders over 14 years as a loan underwriter. Getting financing for condominiums and PUDs can be problematic if:
· owner-occupancy is low
· delinquency on HOA dues exceeds certain parameters
· there is active litigation going on between the HOA and other parties
· if the HOA is underfunded and dues and special assessments are spiraling out of control.
At the very least, buyers will find that they may not get the very best interest rate or lowest fees when locking their loan on such a condo unit. Right now, financing has once again become available for condo projects with low owner-occupancy or other factors previously mentioned. However, that comes with a price. Some investors will increase the interest rate by 1/8% and other provide an add-on to the closing costs. The good news is that the shut-down we experienced for the last several years has loosened more recently. Buyers who have a FNMA DU underwriting approval are finding it less expensive to get financing in such projects in many instances because the conditions of the approval call for Limited Review of the condo or PUD project.

Also, in serving as Vice President of the Board of Directors for an almost 800 unit condominium project with a multi-million dollar annual budget for 2 years, I gained a good deal of property management experience. Over those 2 years, we, as Board had::
· obtained a new Reserve Study
· upgraded the gym facility to incorporate new lifecycles, stairmasters, treadmills and a full universal gym into a newly annexed area with the remodel

· undertook other major capital improvement projects
all of which were highly valuable experiences in learning the property management aspect for condominiums. So, I can assist my clients in reviewing the financials to help identify issues. It is, however, always the prospective buyers job to review all documents turned over by the seller on their own and be sure they are comfortable with the situation. CONDO and Townhouse Document Evaluations
A critical factor Investors need to know is whether there are Rental Restrictions in effect when they are purchasing an investment property. Some projects have a one or two year waiting list for units to be allowed to be rented out. This problem could definitely turn what looks like a “good investment” into a nightmare if the investor cannot put a new tenant into the property. While there is no guarantee that homeowners will later vote to recommend Rental Restrictions, it is valuable to know upfront. If the Owner-occupancy is under 50%, it will probably be hard for the owner occupants to organize a majority of the owners to vote for Restrictions. So, typically, that kind of change will only be voted through when they hold a solid majority. Investors get wind of that change coming and usually have time to mount opposition to such plans.

Where I saw a discrepancy between multiple agents, I tried to adjust for inaccuracy. But, this data is factual as of the time of the listing and that unit the data was reported about, only. If maintaining this list becomes overly time consuming, I intend to pull the list off of the net, altogether. But for the time being, it may serve my clients well in making a quick assessment of the project as a target investment. Any prospective buyer should rely on a more detailed analysis by reviewing the actual Disclosure package that they receive once in contract and review the Reserve Study and accompanying financials carefully to feel comfortable with the actual financial stability of the project before signing off on contingencies. As someone experienced in this process, I am always glad to assist my clients in answering questions they have about the documents and doing further exploration with the management company when we are in contract.
One of the many things I bring to the table as an agent is the experience in having been in charge of Project Approval for several lenders over 14 years as a loan underwriter. Getting financing for condominiums and PUDs can be problematic if:
· owner-occupancy is low
· delinquency on HOA dues exceeds certain parameters
· there is active litigation going on between the HOA and other parties
· if the HOA is underfunded and dues and special assessments are spiraling out of control.
At the very least, buyers will find that they may not get the very best interest rate or lowest fees when locking their loan on such a condo unit. Right now, financing has once again become available for condo projects with low owner-occupancy or other factors previously mentioned. However, that comes with a price. Some investors will increase the interest rate by 1/8% and other provide an add-on to the closing costs. The good news is that the shut-down we experienced for the last several years has loosened more recently. Buyers who have a FNMA DU underwriting approval are finding it less expensive to get financing in such projects in many instances because the conditions of the approval call for Limited Review of the condo or PUD project.

Also, in serving as Vice President of the Board of Directors for an almost 800 unit condominium project with a multi-million dollar annual budget for 2 years, I gained a good deal of property management experience. Over those 2 years, we, as Board had::
· obtained a new Reserve Study
· upgraded the gym facility to incorporate new lifecycles, stairmasters, treadmills and a full universal gym into a newly annexed area with the remodel

· changed out carpet and property management and
· undertook other major capital improvement projects
all of which were highly valuable experiences in learning the property management aspect for condominiums. So, I can assist my clients in reviewing the financials to help identify issues. It is, however, always the prospective buyers job to review all documents turned over by the seller on their own and be sure they are comfortable with the situation. This information source is compiled based on information provided by others on MLS and not intended to be the sole basis for any buyer to decide on a prospective property.
